Статья посвящена правовой легитимности самопровозглашённой независимости Косово. Данное событие не только стало острейшим вызовом мировой общественности, расколов её на два лагеря, но и до сих пор претендует на статус прецедента для ряда территорий по всему миру. В статье автор рассматривает две точки зрения на проблему правомочности косовского суверенитета и, соответственно, две основные правовые нормы, которые являются базисными для этих точек зрения – принцип территориальной целостности и право народов на самоопределение. Они дополняются конкретными правовыми документами по Косово, в т. ч. резолюциями ООН, которые должны были определять статус края. Делается вывод о нарушении ранее достигнутых международных договорённостей, но вместе с тем основная причина существующей проблемы представляется в виде противоречия между принципом территориальной целостности и правом народов на самоопределение. Именно этот сбой в механизме международного права позволил придать независимости Косово хоть и туманную, но всё же завесу легитимности.

The article considers the legitimacy of the sovereignty of the former Serbian province of Kosovo. The basis of the study is the analysis of two legal traditions of the sovereignty effectiveness, which clashed in case of Kosovo – the right of people to self-determination and the principle of territorial integrity. Opponents of the self-proclaimed independence of Kosovo reinforce the matter of violation of the territorial integrity princiole of Serbia by trampling the previous international agreements. Supporters of Pristina, besides appealing to the right of Kosovans to self-determination, draw attention on non-legal grounds of the independence of province, namely the uniqueness of this case and the impossibility of performance of the UN Security Council resolutions against it.
The author concludes that the recognition of Kosovo's sovereignty can not be legitimate, since the international law has no recognition of the precedence of law of people to self-determination before the principle of territorial integrity, and international agreements on the status of the region have been violated.
