В статье рассматривается современное содержание доверительной собственности на недвижимое имущество в английском праве, и те результаты, которые принесло принятие Закона о доверительной собственности на недвижимое имущество и назначении доверительных собственников 1996 года. Проанализировано положение доверительного собственника и бенефициаров, их права и обязанности, а также рассмотрены такие виды доверительной собственности на недвижимость как «простая доверительная собственность» и «подразумеваемая доверительная собственность с целью продажи».

The article examines the trust of land in England, describes the results that have been brought by the reform of trust of land carried out in the end of the XX century, which has changed the provisions of the Law of Property Act 1925. The author examines the changes that were made by the following Statutes: Trust of land and appointment of trustees Act 1996, Trustee delegation Act 1999, Trustee Act 2000. The purpose of the article is to discover the main provisions of bare trust, trust for sale, expressed trust for sale, changes in powers of trustees and beneficiaries, delegation of the trustees and beneficiaries powers. The author also considers the beneficiary's right to occupy the land and the situations where it does not arise, notes that TLATA covers all types of trust of land and provides to the trustees very wide powers, endues the trustees fee simple absolute title to the land (only to the land transferred to trust).
