В статье рассматривается тема обновления основных фондов на базе их модернизации, что является важнейшим условием для формирования инновационной экономики в России. Проводится анализ сложившегося регионального инвестиционного законодательства, которое позволяет выделить основные направления и формы участия региональных властей в этом процессе, а также структуру источников финансирования обновления основных фондов.

Updating of fixed assets on the basis of their modernization is a major precondition for the formation of innovation economy in Russia. This process can be realized in two ways: a) via the modernization of used assets by replacing them with new and more powerful, but relative to the same generation of technology (in fact, it is a remodernization and reconstruction), and b) via the modernization of fixed assets by the implementation of scientific technological progress and the development of innovative character. Therefore it's necessary to make a distinction, which is currently not well defined either in economic practice or in legislation, namely the distinction between two concepts – "update" and "innovation". Replacing of an old equipment with new is not an innovation, but only upgrades which is extremely important for the economy, and without which it is impossible to start the transition to innovative development. Namely the modernization and reconstruction of existing production remain the main focus of investment policy in the Russian regions. Analysis of the existing regional investment legislation allows identifying the main trends and forms of participation of regional authorities in this process, and sources structure of financing of fixed assets updating. As for the innovation stage of development, this process in the regions is very slow and is far below the world level. Serious obstacle to capital renewals through modernization and innovation is the absence of real requests for innovations from specific economic subjects. Practical responsibility for the solution of this problem lies on the authorities of subjects of the Russian Federation which developing the investment-innovative policy should find the appropriate organizational legal mechanisms and financial instruments of formation of the demand for innovative products.
