На основании сравнительного анализа действующего законодательства Украины и других стран, cделаны выводы, что использование зарубежного опыта противодействия преступлениям, связанных с нарушением авторского права и смежных прав является позитивным шагом относительно усовершенствования нормотворческой и правоприменимой деятельности в Украине.
Сделан вывод, что исследование проблем преступной деятельности, связанной с нарушением авторских прав и смежных прав в сравнительно-правовом поле позволяет, с одной стороны, учесть позитивный опыт зарубежного правотворчества, из другой, – адекватно отобразить современное состояние и перспективы противодействия этим преступлениям в Украинском законодательстве и при необходимости его усовершенствования.

The international experience of crimes counteraction against the objects of copyright and related rights investigated in the paper. The legislation in the UK, Netherlands, Spain, Italy, France, Germany, U.S. is analyzed in the article. These countries are considered to take the leading part in anti-piracy drive.
It is noted that their legislation does not create difficulties in proving copyright and related rights infringement that allows detecting such violations by introducing the practice of interior affairs bodies, to confiscate counterfeit, to restore the violated rights of the authors.
In the conclusion the author proves the use of international experience, which includes not only introduction of criminal and civil law and the legislation in national science, but adaptation in accordance with national traditions and the experience gained in preventing of violations in intellectual sphere.
