В статье рассматривается аспект развития структуры холдингов как формы существования в законодательстве Российской Федерации. Характеризуется возможность регулирования правового положения холдингов как отдельной категории юридических лиц.

The article discusses the development of the structure of holdings as a form of existence in the legislation of the Russian Federation. The possibility of regulating the legal status of holdings as a separate category of entities shall be regarded.
Holdings are now the most common legal form of industrial and economic systems but there is still no issued general law concerning these economic entities. There are only scattered rules on certain types of holdings in the legislation law. However, provisional regulations on holding companies created by the transformation of state enterprises into joint stock companies. But such normative acts are applied only to holdings created in the process of privatization, headed by parent companies (holding companies) with more than 25% of assets owned by the state. Moreover, in the specified time position holdings status is determined not directly but pursuant to the rights and obligations of their head holding companies, which makes it impossible to determine the structure and relationships of these links of economic systems as integral economic entities to solve other problems of their legal organization. To have a clear legal status settlement holdings should publish a general regulation to all such economic systems – the law on industrial and economic complexes or other similar legal acts, which would apply to all entities of the type that would be particularly important for implementation of economic concentration required in the real sector in the transition to an innovative economy.
Currently in our country contractual regulation is widely used for the purpose of legal organization activities. It becomes necessary due to the lack of specific legislation on holdings.
