Статья посвящена рассмотрению особенностей требований, предъявляемых к решениям суда, вынесенным по делам о расторжении брака. В статье автор детально анализирует требования, предъявляемые к форме и содержанию судебного решения. По результатам анализа делается вывод о необходимости соблюдения баланса частного и публичного интересов при вынесении решений о расторжении брака.

The article explores the peculiarities of the requirements for divorce court decisions. The author of the article gives a detailed analysis of the requirements for the form and content of judgements. The results of the analysis carried out by the author show that there is a need to balance private and public interests in making divorce decisions. Despite the amendments that have been adopted, the state continues to exercise control over marriage and family relations through registration of the fact of a dissolution of marriage and giving former spouses a certificate that has legal significance. Spouses are not eligible to enter into a new marriage before obtaining a certificate of dissolution of marriage. The author of the article points out that the court may not dismiss petitions for dissolution of marriage. The author considers this to be the priority of the interests of a petitioner or both spouses. It also should be noted that effective legislation sets out a number of mandatory provisions to be followed by spouses during the process of dissolution of marriage. Therein lies the priority of the public interest in the regulation of the divorce procedure.
