В статье рассматривается институт представительства, а именно представительство иностранных лиц в гражданском процессе. Определяются значимость данного вопроса, общие положения, особенности и проблемные моменты представительства иностранных лиц.
[ENG]
The article deals the institution of representation in civil litigation. The author of the article thinks that representation of foreign persons in civil litigation is a matter of some difficulty. The article demonstrates the importance of this issue, determines the general provisions and describes the features and problematic aspects of representation of foreign persons. The institution of representation of foreign persons in civil litigation is considered to be a topical issue due to the fact that the number of cases involving foreign persons that courts of general jurisdiction in the Russian Federation consider and resolve is increasing. The article explores the essence of the problems that have been identified and describes the opinions of scientists who are carrying out research on the institution of representation of foreign persons in civil litigation. The author of the article has come to the following conclusion: there are gaps in the civil procedural legislation of the Russian Federation and these problems require careful consideration. The author also shows the main directions for improvement of legislative regulation of the institution of representation in civil litigation in general and representation of foreign persons in particular.
